Your privacy matters. This policy explains what information we collect, how we use it, who we share it with, and how you can control your data. We never sell your personal information.

Latino Memphis, Inc. (“Latino Memphis,” “we,” “us,” or “our”) operates the website located at latinomemphis.org (“Site”). This Privacy Policy describes how we collect, use, share, and protect personal information when you visit our Site, use our services, or communicate with us through any channel, including phone, SMS, email, WhatsApp, Facebook Messenger, and in-person interactions.

1. Who We Are

Latino Memphis, Inc. is a 501(c)(3) nonprofit organization that serves and supports the Latino and Hispanic communities in the Memphis metropolitan area. Our programs include immigration and legal services (Derechos), information and referrals (El Centro), community health and nutrition (Tu Salud), advocacy and outreach (Tu Voz), family reunification and victim support (Puentes), and digital literacy and job readiness (Senderos). Our principal office is located at 6041 Mt. Moriah Ext., Suite #16, Memphis, TN 38115.

2. Information We Collect

We collect information in several ways depending on how you interact with us. We limit our collection to information that is relevant and necessary for the purposes described in this policy.

2.1 Information You Provide Directly

When you interact with our Site or services, you may provide:

Contact form submissions. Name, email address, phone number, subject, message content, message topic, selected program interest, and optional file attachments (PDF, DOCX, Pages, TXT, JPG, HEIC, AI, PSD; up to 128MB per file, maximum 3 files).

Job Board employer submissions. Contact name, email, phone number, employer name, employer description, employer address, employer phone and fax, employer website URL, employer LinkedIn and Facebook pages, job title, classification, category, salary information, position summary, responsibilities, experience and education requirements, benefits, and application instructions.

Donation information. When you click a donation link on our Site, you are directed to Network for Good, a third-party platform. We do not collect or store your payment card information. Network for Good may share your name, email, mailing address, and donation amount with us so we can acknowledge your contribution and maintain donor records.

Volunteer registration. When you register through Volunteer Odyssey, a third-party platform, that platform collects your registration information under its own privacy policy. Volunteer Odyssey may share your name and contact information with us to coordinate your volunteer activities.

Partnership and subscription forms. When you complete a partnership inquiry or newsletter subscription through Google Forms, Google collects your responses under its own privacy policy. We receive the information you submit through those forms.

SMS/MMS opt-in. Phone number and consent to receive text messages.

Phone and messaging communications. When you contact us by phone, WhatsApp, or Facebook Messenger, we may collect your phone number, name, and the content of your communication to respond to your inquiry and connect you with the appropriate program.

Press inquiry submissions. Name, media outlet, company name, email, phone, subject, and message content.

2.2 Information Collected Automatically

When you visit our Site, certain information is collected automatically through server logs and similar technologies:

Log data. Internet Protocol (IP) address, browser type, Internet Service Provider (ISP), date and time stamps, referring and exit pages, and general navigation data. This information is collected as a standard part of web server operations. It is not linked to personally identifiable information.

Cookies and similar technologies. Our Site uses cookies to store visitor preferences, enable site functionality, and support analytics. Cookies are small text files placed on your device by your web browser. See Section 7 for details on the cookies we use and how to manage them.

2.3 Sensitive Information Collected for Direct Services

Some Latino Memphis programs require the collection of sensitive personal information in order to provide direct services, referrals, or assistance with government and legal processes. This may include:

  • Social Security numbers (for SNAP and other public benefits applications)
  • Immigration-related information and case documentation
  • Proof of identity or eligibility for services
  • Household and demographic information required for government forms

We do not request or require Social Security numbers or other highly sensitive personal information through SMS, WhatsApp, or public website forms.

Sensitive information is collected only through secure, private, in-person, encrypted, or otherwise protected service processes.

We use this information solely for the purpose of providing requested services, such as assistance with SNAP, government aid applications, immigration-related services, and legal or social service referrals.

We do not use sensitive information for marketing purposes, and we do not sell or share this information with third parties, except as necessary to:

  • Complete applications on your behalf
  • Comply with legal obligations
  • Coordinate services with trusted partners when necessary and appropriate

Access to sensitive information is limited to authorized staff, and we implement additional safeguards to protect this data.

2.4 Information We Do Not Collect Through This Site

We do not collect the following types of information through this Site:

  • Social Security numbers
  • Immigration case numbers or immigration status
  • Payment card numbers, bank account numbers, or other financial account details (donations are processed by Network for Good on their platform, not on our Site)
  • Health or medical records
  • Biometric data

Some of our programs, particularly Derechos (Immigration and Legal Services) and Tu Salud (Community Health), may collect sensitive information in the course of providing direct services. That information is collected through separate, secure processes and is not collected through this Site’s public-facing forms.


3. How We Use Your Information

We use the information we collect for the following purposes:

Responding to inquiries. To process and respond to your contact form submissions, route your message to the appropriate staff member or program, and follow up on your request.

Operating the Job Board. To publish employer-submitted job listings on our Community Job Board and to communicate with employers about their submissions.

Processing donations. To acknowledge your donation, issue tax receipts, maintain donor records, and communicate with you about our work and impact.

Coordinating volunteers. To connect you with volunteer opportunities and communicate about upcoming activities.

Providing SMS/MMS communications. To send you messages about programs, service-related resources, support, or other community-related information (not marketing) after you opt in.

Sending organizational updates. To send newsletters, event information, and community updates to individuals who have subscribed through our forms.

Improving our Site. To understand how visitors use our Site through aggregate analytics data, identify technical issues, and improve site functionality and content.

Complying with legal obligations. To comply with applicable laws, regulations, and legal processes.

Protecting our community. To detect and prevent misuse of our Site, enforce our Terms and Conditions, and protect the safety of the individuals and communities we serve.

4. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties. We do not share your personal information for marketing or promotional purposes.

No mobile information, including phone numbers collected through SMS/MMS opt-in, will be shared with third parties or affiliates for marketing or promotional purposes. All categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties.

We may share your information in the following limited circumstances:

4.1 Third-Party Service Providers

We use third-party services to operate our Site and programs. These services may receive or process your personal information as described below:

Network for Good processes online donations on our behalf. When you make a donation, you are directed to their platform. Network for Good’s collection, use, and protection of your payment and personal information is governed by Network for Good’s privacy policy (networkforgood.com/about/privacy/).

Volunteer Odyssey manages our volunteer registration and coordination. When you register as a volunteer, you are directed to their platform. Volunteer Odyssey’s handling of your information is governed by their own privacy policy.

Google provides multiple services we use, including Google Forms (for partnership inquiries and newsletter subscriptions), Google Maps (embedded on our Site for directions), and Google Analytics (for aggregate site usage data). Google’s handling of your information is governed by Google’s privacy policy (policies.google.com/privacy).

WordPress is the content management platform that hosts our Site. WordPress and its associated plugins may process technical data related to site functionality.

Facebook/Meta provides social media services and Facebook Messenger, which some users use to communicate with us. Meta’s handling of your information is governed by Meta’s privacy policy (facebook.com/privacy/policy/).

WhatsApp (owned by Meta) is used by some community members to communicate with our staff. WhatsApp’s handling of your information is governed by WhatsApp’s privacy policy (whatsapp.com/legal/privacy-policy).

Kroger and Superlo Foods operate Community Rewards programs referenced on our Site. If you participate in those programs, those companies handle your information under their own privacy policies. We receive aggregate donation information from those programs, not your personal shopping data.

Amazon hosts our organizational wishlist. If you purchase items from our wishlist, Amazon handles your transaction under Amazon’s privacy policy.

4.2 Legal Requirements

We may disclose your information if required to do so by law, court order, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to comply with applicable law, protect our rights or safety, or protect the rights or safety of others.

We take requests for user information seriously and will evaluate any legal demand for compliance with applicable law before responding. We will notify affected individuals of legal demands for their information when permitted by law and when doing so would not compromise an ongoing investigation or endanger any individual.

4.3 Organizational Transfers

If Latino Memphis merges with, is acquired by, or transfers its operations to another organization, your information may be transferred as part of that transaction. We will notify you of any such change through our Site or by other appropriate means.

5. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law.

Contact form submissions are retained for the period necessary to respond to and resolve your inquiry, plus a reasonable period for follow-up and record-keeping.

Donor records are retained in accordance with IRS record-keeping requirements for tax-exempt organizations.

Job Board submissions are retained for the duration of the job listing (up to 90 days after posting) plus a reasonable period for record-keeping.

Server logs are retained in accordance with our hosting provider’s standard retention practices and are routinely overwritten.

SMS/MMS opt-in records are retained for the duration of your subscription and for a reasonable period after you opt out, to ensure we honor your opt-out request.

When personal information is no longer needed, we delete it or render it non-identifiable using reasonable measures.

6. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect the personal information we collect and maintain. These measures are designed to protect against unauthorized access, alteration, disclosure, or destruction of your personal information.

No method of transmission over the internet or method of electronic storage is completely secure. While we strive to use commercially reasonable means to protect your personal information, we cannot guarantee its absolute security. Do not submit sensitive personal information such as Social Security numbers, immigration case numbers, or financial account numbers through our contact form or file upload feature.

7. Cookies and Tracking Technologies

7.1 What Cookies Are

Cookies are small text files placed on your device by your web browser when you visit a website. They serve various functions, including remembering your preferences, enabling site features, and collecting usage data.

8. Children’s Privacy

Our Site is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13 through this Site. If you are a parent or guardian and believe your child has submitted personal information through our Site, please contact us through our Contact page (latinomemphis.org/contact/) and we will take steps to delete that information.

9. Your Rights and Choices

9.1 SMS/MMS Opt-Out

If you consent to receive SMS/MMS messages from Latino Memphis:

  • Messages are one-to-one and service-related (not marketing)
  • Message frequency varies based on service needs
  • Message and data rates may apply
  • You may opt out at any time by replying STOP
  • For assistance, reply HELP or contact us directly
  • Carriers are not responsible for delayed or undelivered messages
  • Consent to receive SMS messages is not a condition of receiving services

After you send STOP, you will receive one final confirmation message confirming that you have been unsubscribed.

How You Provide Consent

You may opt in to receive SMS messages by:

  • Completing an online or paper form and selecting the SMS consent option
  • Providing verbal or written consent during service intake or registration
  • Initiating a text message conversation with us

We do not share, sell, rent, or disclose phone numbers collected for SMS purposes. Mobile opt-in information is never shared with third parties or affiliates for marketing purposes.

9.2 Email Communications

If you receive email communications from us and wish to unsubscribe, follow the unsubscribe instructions included in each email or contact us through our Contact page (latinomemphis.org/contact/).

9.3 Access and Correction

9.4 Deletion

You may request that we delete personal information we have collected from you. We will comply with your request unless we are required to retain the information by law or for legitimate organizational purposes (such as IRS donor record-keeping requirements). 9.5 Do Not Track

Some web browsers transmit “Do Not Track” signals to websites. Because there is no industry standard for how to respond to these signals, our Site does not currently respond to Do Not Track signals. We will update this policy if a uniform standard is adopted.

10. Third-Party Websites and Services

Our Site contains links to third-party websites and services, including but not limited to Network for Good, Volunteer Odyssey, Google Forms, Facebook, Instagram, LinkedIn, YouTube, Facebook Messenger, WhatsApp, Amazon, Kroger, Superlo Foods, employer websites listed on our Job Board, NAKASEC, CASA, EdTrust Tennessee, Apple App Store, and Google Play.

This Privacy Policy applies only to information collected through our Site and services. We are not responsible for the privacy practices of third-party websites or services. We encourage you to read the privacy policies of any third-party site you visit.

11. Sensitive Information and Community Safety

Latino Memphis serves a community that includes individuals in vulnerable circumstances. We are committed to handling all personal information with care, particularly information related to individuals seeking immigration services, legal assistance, health services, and other community support.

We do not collect immigration status information through this Site. We do not use personal information collected through this Site to make determinations about immigration status or eligibility for services based on immigration status. Information collected through our programs’ direct service delivery is handled separately from website data and is subject to applicable confidentiality obligations.

We encourage all users to share only the minimum information necessary for their inquiry when using our contact form and other Site features. Do not include sensitive personal details in a general website inquiry that are not required for your specific request.

12. Data Breach Notification

In the event of a data breach affecting your personal information, we will notify affected individuals in accordance with the Tennessee Data Breach Notification Law (Tenn. Code Ann. 47-18-2107) and any other applicable law. Notification will be provided without unreasonable delay and will describe the nature of the breach, the types of information affected, and the steps we are taking in response.
